Definitions: In these terms and conditions the following terms will have the following meanings:

Contract – Means any order of goods by Customer that is accepted by us.

Goods – Any Goods forming the subject of a Contract including parts of, or materials incorporated in, them as more particularly described upon this Website

Prices Payment:

The Price of the Goods is set out on the website and on the confirmation of the order.

The Price is in Pounds Sterling and includes Value Added Tax at the current UK rate.

In the event that there is a pricing error on the website then Charms Bathrooms will be bound to honour any orders. (See section on Order Processing).

Payments can be made either by Master Card, Visa, Maestro or Switch.

Delivery Coverage and Charges:

We will only deliver within a 50 miles radius of our registered office address. Deliveries will be made on our own transport where appropriate or by other means namely recorded delivery or carrier.

Order Processing:

When you complete your personal details and select the Goods that you wish to purchase and submit them to us, a contract is formed between you to purchase the Goods at the prices shown on the website and us to supply them at the prices shown on the website subject to these terms and conditions.

We will send you an email to confirm that we have received your order and to advise you of an approximate despatch date. Please note, that in the unlikely event that the Goods are no longer available, we will advise you of this, so that you may select either an alternative product or a full refund. In order to buy the Goods from us through this website you must be at least 18 years old.

We reserve the right at our discretion to refuse to complete a contract for the sale of Goods to you. Charms Bathrooms will not be held responsible for any misprints or spelling mistake relating to the description of the product.

Cancellation of Order:

Orders can be cancelled by emailing simonmartin@charmsbathrooms.co.uk or telephone us on 01423 870111.

We will respond to your request by email and confirm that your order has been cancelled or has already been despatched.

Orders that are cancelled after despatch by us are subject to the delivery and return collection charges incurred.

Delivery Schedule:

All our products are specifically ordered for you, we will notify you by email the delivery forecast for each item on your order.

We will usually ship your order complete once all the goods come into stock.

Delivery dates are only approximate and we accept no liability whatsoever in respect of late deliveries.

Our Driver may also ask to see identification before leaving the goods, (to protect us from Credit Card Fraud). Do not book any installers until the goods have been received and checked for damages and shortages by you.

No liability can be accepted for costs by late deliveries or for any other reason.

Heavy and bulky items may require assistance by the driver to off load them from the vehicle.

This assistance will be required from the customer.

Delivery Acceptance:

We will contact you on the day prior to delivery direct to arrange for a suitable time to make the delivery.

Small and single items will be sent by FedEx.

Goods will only be delivered to the customer’s address (they cannot be left with a neighbour) and the packaging must be checked for damage and signed for by either you or your appointed agent. (Signing unchecked will not be accepted).

Where the packaging is damaged the goods must be opened and inspected at the time of delivery any damages discovered will be returned with our driver and a replacement will be ordered on his return to our office.

You must also email us immediately to inform us of the damage so that we can arrange for a replacement and the damaged goods to be collected at no cost to you.

All goods must be opened and inspected and any damages must be notified by email within 24 hours of delivery.

Any loss or damages after that period will be at your risk.

Any shortages or incorrect items must be notified on the consignment note and by email to simonmartin@charmsbathrooms.co.uk at the time of delivery.

If the delivery is to a communal building like a block of flats, please note that the driver may require help unloading.

As soon as the goods have been delivered and signed for, they become your responsibility.

Our driver is instructed to wait whilst you check the packages against the delivery note.

If you are using a representative to sign for the goods on your behalf, please ensure that they follow these instructions and carefully examine all the packages.

If you or your appointed agent is not able to accept the delivery at the appointed time agreed with then you must contact us to arrange an alternative delivery, failure to do so could result in you being charged for the second delivery.

All deliveries are to kerbside only although the driver may carry some items into the hallway at their discretion.

Returns Refunds:

If you have received the goods in good condition but are not satisfied with the order or you have changed your mind, you may return the goods within 7 days of delivery for a full refund of the product price. Charms Bathrooms will not refund any delivery charges.

We will issue refunds within 28 days.

You must advise us by email to simonmartin@charmsbathrooms.co.uk and we will issue you with a returns document.

Please fill in the document and return to us by e-mail. All goods must be returned in their original packaging and in a saleable condition and at your cost.

It is your responsibility to ensure that returned goods reach us in good condition.

We recommend you take out carrier insurance to cover the cost of any unforeseen damages as products returned to us in an un-saleable condition will not be refunded.

No returns will be accepted until Charms Bathrooms have received and approved a valid returns form.

Please do not write on or damage the original packaging as this will render the package un-saleable, and you will not be refunded.

Return of Faulty Goods:

Faulty goods must be notified to Charms Bathrooms by e-mail or phone within 24 hours of receipt.

We will issue a returns form which must be completed.

Once Charms has received and approved the return form we will arrange for the product to be collected from you.

We would ask you to provide the item packed in its original packaging.

We will either replace the faulty item at no additional cost to your or if a full refund is required we will refund the item in full.

We will contact you to arrange a convenient collection time, should you fail to be present at the agreed time without giving reasonable notice then we reserve the right to charge for any subsequent collections.

A replacement product or refund will only be issued once the faulty product has been received by us.

Please follow the above instructions carefully, as we will not replace or refund faulty/damaged items unless they are notified within 24 hours hours

Non faulty products returned after the seven day cooling off period, will be subject to a 17.5% restocking charge and no carriage charge will be refunded.

Please note that Your Right to Return Goods pursuant to the Distance Selling Regulations 2000 does not apply in this contract where the goods are manufactured for You or customised to Your specifications.

Extent of Liability:

Whilst every effort is made to ensure that the goods are accurately described on our website, the descriptions do not form any part of the contract between you and us.

They are designed to represent a general idea of the goods.

You should ensure that the goods which you are purchasing from us are suitable for your intended purpose, if you need assistance please contact Simon on 01423 870111 between 9am – 5pm Monday to Friday and 9am – 1pm Saturday.

However we do not give any warranty that the goods, which you purchase from us, are suitable for your intended purpose.

We will not be liable to you for any loss or damage which you suffer as a result of any breach by us of this contract, including, but not limited to, consequential loss to you and/or loss or damage to the property of third parties.

In any event our liability to you arising directly from our negligence will not exceed the invoice value of the goods.

Nothing in this clause will limit our liability for death or personal injury resulting from our negligence.

This clause does not affect your statutory rights.

We make every effort to ensure that this Website is free from viruses or defects.

However, we cannot guarantee that your use of this website or any website accessible through it will not cause damage to your computer.

It is your responsibility to provide adequate protection for your equipment which you use to access this website.

We will not be liable to you or to anyone else for any loss or damage which may be caused to any equipment arising as a result of your use of this website.

Law Jurisdiction: The contract between us will be governed by English law and we and you consent to the exclusive jurisdiction of the courts of England Wales.

If you access the website from locations outside England and Wales you are responsible for complying with any laws applicable to that territory.

Credit Card Services: All card transactions on this site are handled through Paypal; this is a third party specialist processing company that utilises 256bit encryption.

Every transaction we process is also checked by our fraud control systems to validate the authenticity and validity of your payment card as well as indicators of possible fraudulent use.

Warranty: All goods supplied by Charms Bathrooms and Kitchens Ltd are warranted free from manufacturing defects for 12 months from the date of delivery (unless otherwise stated).

This warranty does not affect your statutory rights as a consumer.

This warranty does not apply to any defect in goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the manufacturer, failure to follow the Manufacturers instructions, misuse, or any alterations or repair carried out without the Manufacturers approval.

If the goods supplied to you develop a defect in relation to their quality of condition while under warranty you should notify Charms Bathrooms and Kitchens Ltd in writing via the e-mail address or fax number as soon as possible, but in any event within a reasonable time after the defect or failure is discovered.

Where any valid claim in respect of any of the goods which is based on any defect in the quality or condition of the goods or their failure to meet specification (other than in respect of a bespoke specification) is notified to Charms Bathrooms and Kitchens Ltd in accordance with these conditions of supply, Charms Bathrooms shall be entitled to replace the goods (or the part in question) free of charge or, at our sole discretion, refund the price of the goods (or a proportionate part of the price), but we shall have no further liability to you.
